Ownership of the online shop Vinte Vinte Chocolate ‘shop.vintevintechocolate.pt’ HILODI – HISTORIC LODGES & DISCOVERIES, S.A., a public limited company, with its registered office at Rua do Choupelo, nº250, 4400-088 Vila Nova de Gaia, with the tax and legal person identification number 513.165.096, with share capital of €4,050. 000.00, RNAAT no. 567/2020, is the promoter of the Public Entertainment Venue – Theme Park, with the name World of Wine (hereafter identified as WoW), and is also the legitimate owner of the domain www.wow.pt and the virtual shop – www.shop.vintevintechocolate.pt – (hereafter identified as Loja Virtual Vinte Vinte Chocolate).

3. Object and scope
3.1. These Terms and Conditions apply to all orders placed by the Customer (hereinafter referred to as ‘the Customer’) with HILODI – HISTORIC LODGES & DISCOVERIES, S.A, 513.165.096, (hereinafter referred to as ‘Hilodi’ or ‘we’), on the Hilodi websitewww.wow.pt,e in the Vinte Vinte Chocolate Online Shop.
3.2 Browsing the site, as well as the purchase of any product in the Vinte Vinte Chocolate Virtual Store, presupposes acceptance of these Terms and Conditions.
3.3 ‘End consumer’ or ‘User’ or ‘Customer’ means any person aged 18 or over who acts/buys for purely personal purposes, outside of their commercial, industrial, craft or professional activity, and therefore has no desire to resell the items they purchase from the Vinte Vinte Chocolate online shop.
3.5. Through the Vinte Vinte Chocolate Online Shop, HILODI sells all of its merchandising products from a wide variety of suppliers and will be the entity responsible for selling Vinte Vinte Chocolate or Vinte Vinte brand items in the Vinte Vinte Chocolate Online Shop, with all e-commerce services being available only to end consumers.
3.5. HILODI reserves the right to amend these Terms and Conditions without prior notice, as well as to modify at any time the information and commercial offer presented on products, prices, promotions, commercial conditions and services, and any changes will always be published on the website www.shop.vintevintechocolate.pt.
3.6. HILODI reserves the right not to process any order received from users who are not ‘Final Consumers’ or those who do not agree with these Terms and Conditions.
3.7. The ‘Final Consumer’ must provide HILODI, the owner of the Vinte Vinte Chocolate Online Shop, with an e-mail address or other contact details that are correct and complete and agrees that HILODI may contact him/her using these details if it deems it appropriate.
4. Information on the contents of the Vinte Vinte Chocolate online shop
4.1. The reproduction, transfer, distribution or storage of the contents of the online shop – www.shop.vintevintechocolate.pt, without prior written authorisation granted by Hilodi, is prohibited for any purpose other than strictly personal use.
4.2 Links to our website for commercial purposes or without prior authorisation from HILODI are expressly prohibited. The use of the domainwww.wow.ptcom for abusive purposes, or without prior authorisation, is subject to recourse to the competent legal means by HILODI.
4.3 In the event that you find links on other websites giving you access to www.shop.vintevintechocolate.pt or references to the Vinte Vinte Chocolate online shop, we would like to inform you that HILODI has no responsibility for these links or pages, nor for the content contained therein.
HILODI shall not be held liable for any adverts or campaigns that use the Vinte Vinte Chocolate brand without being authorised to do so.
4.4 We are strongly committed to ensuring that the information presented in the Vinte Vinte Chocolate webshop is free of typographical or clerical errors and whenever these occur, we will correct them as soon as possible.
4.5 All contractual information as well as article information, e-mail communications and formalisation of the sale are/will be written in the language that the ‘User’ or ‘Customer’ has chosen in the options presented in the top right-hand corner of the webshop, with the exception of expressions/foreign language that must be used.
5. Commercial Policy
5.1 In the event that the information presented does not correspond to the characteristics of the product, the Customer has the right to terminate the sales contract under the applicable legal terms.
5.2 The photographs shown on the website are merely illustrative, so we recommend that you consult the product details at length for more information on the characteristics of the items you wish to purchase.
5.3 Product prices and specifications are subject to change without prior notice. Despite HILODI’s extreme attention to keeping all information up to date, some products may contain an incorrect price, so we will check prices whenever we process orders. If the price of the product is lower than the advertised price, we will refund the difference. If the price is higher, we will inform you by e-mail and await your decision to accept the new offer or cancel the order.
5.4 The product catalogue of the Vinte Vinte Chocolate webshop is independent of the physical shops, both in terms of price, products presented and quantities in stock. All promotional campaigns have limited stock and may be exclusive to the Vinte Vinte Chocolate online shop.
5.5 Under the terms of clause 3.2 above, validation of the purchase request or order presupposes that the ‘Customer’ is aware of and accepts these Terms and Conditions.
5.6 All the data recorded by HILODI constitutes proof of all the transactions carried out between HILODI and the ‘Final Consumer’, and HILODI is responsible for archiving the electronic document formalising the contract and undertakes to keep it accessible.
6. Obligations of Customers and Users
6.1 Any visitor to the Vinte Vinte Chocolate webshop undertakes to comply with and respect these general terms and conditions, in particular by observing the following behaviour:
Refrain from introducing, storing or disseminating defamatory, obscene, insulting, xenophobic and/or any other type of content that violates the general principles of law and public order through the Vinte Vinte Chocolate e-shop;
Keep, and not disclose, your password for entering the site in order to prevent third parties from accessing your account and personal data;
Do not use false identities;
Provide correct personal details and addresses so that HILODI can process orders properly;
Users are therefore expressly prohibited from transmitting messages or information that are insulting, misleading, defamatory, obscene or that in any way violate the right to privacy or the intellectual or industrial property of third parties, as well as providing any information that may be harmful to third parties or to HILODI.
HILODI reserves the right to delete the account of any user who fails to comply with any of the aforementioned obligations.
6.2 The Customer is solely responsible for the veracity of the personal data communicated to HILODI and undertakes to enter and immediately inform any changes via their Registration Account in the Vinte Vinte Chocolate online shop at www.shop.vintevintechocolate.pt.
6.3 HILODI disclaims any liability for any delay or impossibility of processing the order, namely at the time of delivery, due to error or insufficiency of the data communicated by the Customer,
7. Placing an order online
To place an order in the Vinte Vinte Chocolate online shop, the ‘User’ must have a valid and frequently used e-mail account.
7.1 Placing an order in the Vinte Vinte Chocolate webshop is very easy:

7.2 As soon as you finalise your purchase, you will receive an automatic e-mail confirming the transaction. We suggest that you print or download the email for future reference.
7.3 In the event of non-confirmation of payment or non-compliance with these Terms and Conditions, and even if there is automatic confirmation of the order, HILODI reserves the right not to accept your order, informing the ‘Customer’ by e-mail that the sales contract has not been made and that HILODI has not proceeded with the sale, specifying the reasons for this circumstance.
8. Product availability and order confirmation/cancellation
8.1. HILODI will only process an order placed by a Customer once payment has been confirmed, so HILODI cannot guarantee the availability of the items until such time as processing has begun.
8.2 HILODI only dispatches orders on working days. Therefore, when estimating the delivery time of orders, weekends and public holidays are not taken into account. Any delay in the dispatch of items, compared to the estimated dates shown, does not entitle the customer to any compensation.
8.3 The fulfilment of all orders placed on the website is subject to product availability. HILODI endeavours to ensure that all items offered for sale on the website are in stock. However, HILODI reserves the right not to accept any orders or to cancel orders already confirmed for products that are no longer in stock. If the product is unavailable and/or out of stock, HILODI will immediately inform the Customer of the partial or total cancellation of his/her order, and the Customer is entitled to a refund of the amount paid.
8.4 The inclusion of any products in the Vinte Vinte Chocolate online shop at any given time does not imply or guarantee that these products will always be available. We reserve the right to discontinue any product at any time.
9. Order confirmation or cancellation
9.1 HILODI may not validate an order that does not have a sufficient guarantee of successful collection, when the order is incomplete or incorrect, or when the products ordered are no longer available. In any of these cases, HILODI will inform the ‘Customer’ within five days by e-mail that the sales contract has not been concluded and that HILODI has not proceeded with the sale, specifying the reasons for this.
9.2 If the products ordered from the Vinte Vinte Chocolate online shop are no longer available when you last access the site, despite having received confirmation of the order, or when HILODI receives your order, it will immediately inform the ‘Customer’ of their unavailability, not later than 30 days after receipt of the order.
9.3 If an order has been placed, and payment made, for products that have become unavailable in the meantime, HILODI will refund the money paid for the unavailable items within a maximum period of 30 days from knowledge of the unavailability.
9.4 HILODI reserves the right to refuse any order for any reason and disclaims liability for any damages or costs, as well as the right to cancel any purchase even if it has already been accepted or confirmed by HILODI, namely in the following situations:
The information on the invoice is not correct or verifiable;
The order is flagged by the website’s Security Systems as an incorrect, irregular orfraudulent order;
When it is not possible to deliver the order to the address provided by the ‘User’;
If it considers that the ‘Customer’ did not have the legal capacity to make the purchase. If it is found that there has been an error in the presentation of the price of the product(s);
If it is assumed that the order comes from an entity that is a reseller.
10. Payment Terms and Security Guarantees
10.1 The payment methods available will be displayed in the Vinte Vinte Chocolate online shop. We do not accept any other payment method than those mentioned.
10.2 You can pay for your products using your usual credit cards, using MEO Wallet, Visa, Mastercard, Multibanco or MB Way.
10.3 When paying by credit card, all details (such as card number, expiry date or security code) will be sent by encrypted protocol to the company that provides remote electronic payment services, MEO Wallet, without third parties being able to access the information transmitted. This information will not be used by the Vinte Vinte Chocolate HILODI online shop, except to carry out the necessary operations for purchase or refund, in the event of a return in accordance with the exercise of the right of return, or for reporting cases of fraud to the police.
10.4 The purchase price of the products and the transport costs, as indicated on the order form, will be charged to the current account when the purchased products are actually dispatched.
10.5 We urge you not to attempt to make payment by any other means not specified in the Vinte Vinte Chocolate webshop. If you do, HILODI cannot be held responsible for loss of payment or any other damage that may result.
11. Security of the Vinte Vinte Chocolate webshop and all transactions
11.1 The Vinte Vinte Chocolate webshop uses the latest and most robust security technologies available for encryption platforms. All payment information you provide will be encrypted from the initial moment of your transaction until the order is processed and will not be stored on any public server.
11.2 Although we use highly advanced encryption software, any payment transmitted over the Internet or via e-mail runs certain risks, particularly when the ‘User’ does not take the necessary precautions and does not assume the necessary behavioural responsibilities.
11.3 HILODI cannot be held liable for any damage suffered as a result of the use of electronic means of communication, in particular damage resulting from failures or delays in the delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programmes used for communications or virus transmissions.
12. Reservation of ownership of commercialised products
HILODI retains ownership of the company’s products until it has received full payment for all such products.
13. Prices
13.1 The prices of the products displayed in the Vinte Vinte Chocolate online shop include Value Added Tax (VAT).
13.2 The total price specified in the final ‘Checkout’ menu includes taxes and shipping costs. Prices are quoted at the time of order confirmation, which you can print out or download for future use. At the time of payment, please only transfer the exact amount specified in the order confirmation and make individual transfers per order.
14. Quality and guarantee
14.1 HILODI will only sell items of the highest quality in the Vinte Vinte Chocolate online shop and will never sell second-hand, defective or substandard products.
14.2. The image and colours of the products offered for sale in the Vinte Vinte Chocolate online shop may not correspond exactly to reality, in particular due to the internet browser and/or monitor used.
15. Product dispatch and delivery
15.1. Products ordered from the Vinte Vinte Chocolate online shop will be dispatched and delivered on working days, Monday to Friday.
15.2. We can only guarantee the successful delivery of an order if the shipping address for the products is correctly indicated by the Customer, and the address is located in Europe.
15.3 A delivery is deemed to have been made or a product is deemed to have been delivered when the delivery receipt is signed at the address indicated.
15.4 Unless expressly indicated by the Customer, or if the billing address is different from the delivery address, the invoice will be sent with the order. HILODI declines all responsibility for any delay or impossibility of processing the order, particularly at the time of delivery, due to error or insufficiency of the data communicated by the Customer.
16. Shipping costs and delivery times
16.1. Shipping costs associated with your order will be invoiced per order, i.e. if you order more than one item, you will only pay the shipping costs once. However, HILODI reserves the right to split the delivery of the order, for example if part of the order is delayed or not available. If we split the order, the customer will be notified of our intention by e-mail. The e-mail address provided by the customer at the time of purchase will be used for this purpose.
16.2. Shipping costs can be found in the footer of the website under ‘Shipping Costs’.
16.3 Upon delivery, the ‘Customer’ must inspect the packaging and the products sent in order to ascertain any damage. If the customer finds that the products are damaged, he/she must not accept delivery of the order, which must be returned immediately via the ‘Returns’ mechanism provided for at www.shop.vintevintechocolate.pt. HILODI will reimburse the amounts paid for the order and transport as soon as it receives and completes the returns process at its head office.
16.4 The order is deemed to have been accepted if, after receiving the order, the ‘Customer’ does not return the order within the following 30 days.
17. Delivery times for orders
17.1. Once your order has been registered, payment has been confirmed and all the items in your order are available, HILODI undertakes to dispatch them in accordance with the following delivery times:
In mainland Portugal, an average of 2 working days.
In Madeira and the Azores, up to 5 working days on average.
In Spain, up to 2 working days.
In Europe, up to 5 working days.
17.2. HILODI shall not be liable for any failure to fulfil, or delay in fulfilling, any shipping obligation caused by a force majeure event, i.e. an event beyond its reasonable control.
17.3 For reasons of quality and food safety, whenever an order includes the Vinte Vinte Chocolate brand, and if it is placed after 12 noon on a Thursday or 11.59pm on a Sunday, orders will not be dispatched until the Tuesday of the following week, or the following working day if that day is a public holiday.
HILODI endeavours to dispatch orders as quickly as possible and in the order in which they are placed. We aim to dispatch within 2-5 working days of an order being confirmed. Although we endeavour to dispatch within the indicated timeframe, this may not be possible for unforeseen reasons. In the unlikely event that the delivery time exceeds 30 days, you may cancel your order.
18. Product cancellations, exchanges and returns Cancellation and Right of Free Resolution If you have purchased an item from www.shop.vintevintechocolate.pt, you have 14 calendar days to return it, from the moment you receive the order, under the terms of the right of free resolution, provided for in Decree-Law no. 24/2014, of 14 February. You may do so provided the following conditions are met:
Presentation of the product purchase invoice.
The product must be delivered in the same condition in which it was sold, with no external damage or signs of use and in perfect working order, packaged in its original packaging and accompanied by the user manual and all its accessories.
Exercise your right of withdrawal, under penalty of forfeiture, within 14 days of the day following the day on which you acquired the goods or a third party indicated by you, other than the carrier, acquires physical possession of the goods.
In order to exercise your right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unequivocal statement, by letter to:

You can use the model resolution form below, but this is not obligatory. You also have the option of completing and submitting the model cancellation form or any other unequivocal declaration of cancellation electronically via our website Internetshop.vintevintechocolate.pt. If you make use of this option, we will send you an email without delay, acknowledging receipt of the cancellation request. For the withdrawal period to be respected, it is sufficient for your communication regarding the exercise of the right of withdrawal to be sent before the withdrawal period expires.
Effects of cancellation: In the event of cancellation of this contract, you will be reimbursed for all payments made, including delivery costs (with the exception of additional costs resulting from your choice of a shipping method other than the least expensive standard shipping method offered by us), without undue delay and in any event no later than 14 days from the date on which we are informed of your decision to cancel this contract. We make such refunds using the same means of payment that you used for the initial transaction, unless you expressly agree otherwise; in any event, you do not incur any costs as a result of such a refund. We may withhold the refund until we have received the returned goods, or until you provide proof of despatch of the goods, whichever is the earlier You must return the goods or hand them over to us without undue delay and no later than 14 days from the day on which you inform us that you have withdrawn from the contract. The deadline is deemed to have been met if you return the goods before the expiry of the 14-day period. If the right of withdrawal is exercised, the Customer will bear the full cost of returning the goods, with the exception of those that cannot be returned by ordinary post. In the case of the return of goods which, due to their nature, cannot be returned by post, the Customer must bear the direct costs of said return which are associated with the shipping costs set out in the parcel dispatch cost table. Please note that you cannot exercise the right of withdrawal for perishable products or personalised products. Therefore, if your order contains Vinte Vinte chocolates, you do not benefit from the right of withdrawal, under the terms of article 17 of Decree-Law no. 24/2014, of 14 February. Product Exchanges Once the order has been received, the ‘Customer’ has a period of 30 days to exchange their item(s). To make the exchange, you must fill in the online exchange form. HILODI will then contact you to explain all the steps you need to take to exchange the item. Exchanges to mainland Portugal, the Madeira archipelago, the Azores and Europe will always be sent by the customer to the following address: A/C. The customer can also choose to exchange the product directly in our physical shops, which does not represent any additional cost associated with shipping.
Product returns
18.2 Upon receipt of the order, the ‘Customer’ has a period of 30 days in which to return the item(s) – if they are found to be defective or otherwise non-conforming.
18.1 If you decide to return the products purchased, HILODI has the right not to accept the return of products if the items returned are not in their original condition and packaging, or if they have been used.
18.3 To make a return, you must complete the online returns form. HILODI will then contact you to explain all the steps for returning the item.
18.4 Returns to mainland Portugal, the Madeira archipelago, the Azores and Europe are always the responsibility of the customer, who must return the product to the following address:

Customers can also choose to return the product directly to our physical shops, which does not entail any additional shipping costs.
18.5 Upon receipt of all or part of the products ordered at our premises, we will process them within a maximum of 10 working days. If the return is confirmed, the amount will be refunded to you using the same payment method. Refunds will only be made to the account/card from which the purchase was made.
19. Conditions applicable to Promotional Codes (discounts)
19.1 When used in accordance with the rules laid down, a promotional code entitles the user to take advantage of a promotion/discount relating to the purchase of a specific product or for a set of products, during the period indicated/associated with the promotional code/promotional campaign.
19.2 Promotional codes are personal and non-transferable and can only be used for online purchases made on the site. The sale, exchange or donation of a promotional code is not permitted. The customer holding the promotional code may not upload or make available a promotional code on any website or other public form of offer, donation, sale or exchange. The use of promotional codes for commercial purposes is not permitted.
19.3 The use of a promotional code is limited to one use per product and per order. Promotional codes cannot be combined with any other promotions or special offers.
19.4 Promotional codes cannot be exchanged for cash and will not be reissued or refunded.
19.5 Without prejudice to any other rights, HILODI reserves the right to immediately invalidate the promotional code issued if it suspects that a promotional code is being used in breach of the above-mentioned conditions.
20. Validity of promotions or commercial campaigns
20.1 Promotional offers or commercial campaigns publicised on the Vinte Vinte Chocolate online shop are valid only for the time they are displayed on the website and in accordance with the conditions set out, unless otherwise stated on the website.
20.2 In the case of returning items purchased as part of commercial campaigns or promotions, you will only be credited or given the amount you actually spent on the purchase of the item you wish to return.
21. Liability
21.1 HILODI shall only be liable for damages suffered by the ‘Client’ in the event that such damages result from breaches attributable to HILODI’s contractual obligations towards the ‘Client’, or in the event that liability results from applicable legal law.
21.2 In the event that the ‘Customer’ has suffered damage related to the activity of the Website, HILODI’s liability shall be limited to: Damage to merchandising products and Vinte Vinte Chocolate marketed, Reasonable and verifiable costs incurred by the ‘Customer’ to find the cause and amount of compensation attributable to the damage as a result of HILODI’s breach of these Terms and Conditions. The maximum reimbursement of the aforementioned compensation will be (if applicable) equivalent to the price of the products in question
21.3. HILODI cannot be held liable for damage suffered by third parties resulting from the use of any of our products. HILODI cannot be held liable for damage suffered by the ‘Customer’ as a result of misuse of our products.
21.4 HILODI shall not be liable for damages resulting from incorrect information on the website.
In the event that the customer suffers damage as a result of gross negligence or wilful misconduct on the part of HILODI, none of the limitations contained in this article shall apply.
Nothing in these Terms excludes or limits HILODI’s liability in respect of any matter in which the exclusion or limitation of liability is held to be unlawful Our maximum liability to you for any loss or damage relating to your order in the Vinte Vinte Chocolate webshop shall be limited to the total price of your order. 21.5 All products commercialised by HILODI on www.shop.vintevintechocolate.ptestão comply with Portuguese legislation.
HILODI declines all responsibility in the event of a breach of the legislation of the country where the order is delivered. It is up to the Customer to check with the local authorities the conditions of import or use of the Products they wish to order. HILODI shall not be liable for damages arising from any interference, interruptions, computer viruses, malfunctions or disconnections of the operating system that may temporarily prevent access, browsing or the provision of services to Users. HILODI is not responsible for situations of unforeseeable circumstances or force majeure resulting from unforeseen events or natural forces beyond human control that cannot be avoided or situations that create the impossibility of fulfilling the service that cannot be attributed or attributable to HILODI, namely in situations such as natural disasters, terrorist attacks, war, epidemics, among others. Whenever this occurs, HILODI will take the necessary measures to inform customers immediately and as soon as it becomes aware of the circumstances and foreseeable consequences of this impossibility.
22. Intellectual and Industrial Property
22.1 HILODI – HISTORIC LODGES & DISCOVERIES, S.A. and its suppliers or licensors retain all intellectual property rights, such as trademarks and copyright, at www.shop.vintevintechocolate.pt. Any use of the Vinte Vinte Chocolate e-shop or its contents, including copying or storing all or part of such contents, for purposes other than personal, non-commercial use by the Customer, is prohibited without the authorisation of HILODI.
22.5. If the ‘User’ wishes to use information or materials contained on the website, he/she must obtain prior written authorisation from HILODI.
23. Applicable law
23.1. These Terms and Conditions and all disputes arising in connection with these general conditions, including their validity, the use of the www.shop.vintevintechocolate.pt website or any purchase on it shall be governed by Portuguese law.
23.2 In the event of a dispute regarding the interpretation or execution of these Terms and Conditions, HILODI and the ‘Customer’ undertake to endeavour to reach an amicable solution, which is fair and adequate, within a maximum of 60 (sixty) days from receipt of the communication addressed to that effect by any of the parties involved.
23.3 In the event of a consumer dispute, the consumer can use the European online dispute resolution platform available at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=PT.
If you wish to make a complaint, you can also contact one of the Alternative Dispute Resolution organisations listed below – the one with territorial competence defined according to the consumer’s area of residence. This alternative dispute resolution body will also be able to answer any questions you may have about this process (under Article 18 of Law 144/2015 of 8 September). In compliance with article 18 of Law no. 144/2015, of 8 September, we hereby inform you that the Alternative Dispute Resolution entities are those listed below:
